The United States Constitution provides protection for people accused of committing crimes. An important protection is the right to be represented by a lawyer. The police officer stops the suspect and “reads him his rights.” This recital begins, “You have the right to remain silent” and informs the suspect that he has the right to have legal representation. This right is based on the Fifth Amendment, one of the amendments in the Bill of Rights. The Fifth Amendment prevents the court from forcing the suspect to do or say anything that would incriminate him. Under ancient societies, an accused person could be tortured into giving a confession. Under this torture, the suspect would likely end up confessing even if he were innocent. The Fifth Amendment prevents this situation from happening because it says you don’t have to say a word. It’s up to the prosecutor to prove your guilt.

Another right guaranteed by the Constitution is the right to have your case heard and decided by a jury of your peers. Choosing a jury trial assures you of being heard openly and fairly. Again, this right means that the court can’t keep you in a secret place and come up with an arbitrary decision. All arguments must be made in the open. In most cases, the jury’s decision must be unanimous.

The Constitution prevents certain laws from being passed. No law that is put on the books can be applied retroactively. This means that, if you performed a certaion action today, the government couldn’t prosecute you if they outlawed that activity next year. The prohibition against passing ex post facto laws is spelled out in Article 1, Section 9 of the Constitution.

Let’s take a look at what the presentation is for; the sole purpose of a presentation is to expose your prospect to the business. The key to giving an effective presentation is finding a need and then filling it with the vehicle of network marketing. Show your prospects how they can get what they want by joining your business.

The very first thing you want to do when you give these presentations is that you want to RELAX and dress appropriately. Also, make sure that you are the one controlling the mood of the get together, whether it be a one on one presentation, a PBR, or a business briefing. This is very important because you don’t want an ounce of negativity around you.

Furthermore, when it comes down to the presentation, make sure you are fully prepared with your distributor and follow up packs. If you are doing a one on one presentation make sure you put the prospect at ease and establish a little bit of rapport.

Find out exactly what it is that your prospect wants, then re-qualify them once you find out exactly what it is that they want by saying something like, “Ok, John, based on what you said you want, how much time are you willing to put into this business without interfering with what you are currently doing?”

It is critical that you include the last part because it decreases the possibility of the “I don’t have the time” factor. Before you even introduce your prospect to your support team member it is important that you edify your support team member before the two of them even meet.

By this, I mean, make it seem like your support team member’s time is extremely valuable and make it an honor for your prospect to be able to meet him/her. By doing this, the prospect will think that your support team member really knows what he is doing and that he can learn some valuable information by listening to him. This point is critical. When it comes to the business briefings, always tell your prospects to be at the briefings 15 to 30 minutes before the actual event starts because the event before the event is where all the action happens. Make sure that you introduce your prospect to as many people as possible in hope that they find someone that they can really relate to.

If the prospect ask you or your support team member what all this is about simply say, ” oh, well, that’s what we’re going to show you in just a couple of minutes, your going to love it.” Then ask them a question about themselves.

The point of the event before the event is to greet and meet people. During the event; however, is serious time. Make sure you and your support team are listening attentively to the speaker and taking a lot of good notes, and always act as if it is your first time at the event. If the speaker says a joke that you have heard a hundred times before, you should still laugh at it.

Furthermore, when it comes to the business briefings, a good idea is to set up half the amount of chairs as the number of people that you expect to come. The reason for this is because if people walk in, and there are more chairs than people, they are going to assume that this business you are doing isn’t going so well; however, if they are walking in and you need to go get them a seat because all the rest of them are taken they are going to think that this thing you have going on must be something pretty good. It is a psychological tactic.

After the event, when you gather all your prospects into your group to see how they liked the briefing, make sure that you have one of your support members with you so that they can answer any questions or objections that come up. Remember, third party always works better.

Have fun with your presentations and keep them short, approximately one hour to two hours long.

Various Cultures within Occupational Health and Safety

ISO 9001 Systems have a few pre-requisites. You need to understand them before you can begin developing or evaluating any quality management System (QMS).

Sequencing is important and cross-checks should be done between these areas throughout the process.

VISION

Managers and employees need to focus their attention on working towards reaching

a common goal. All involved must move in the same direction
and at the same pace. A well thought out vision, mission, and strategy are of the utmost importance to establish your company’s frame of reference and benchmark your performance against your objectives:

• Where do you see your company or business unit in the future?
• What opportunities are available to you that you want to use?

A Vision Statement is a statement of intent - committing yourself and your stakeholders. It’s the “pot of gold” at the end of the rainbow. It’s the success story that prevents complacency and keeps pushing you on to further horizons, to greater accomplishments, and to making plans to achieve your dream. Your vision should not change very much over a period of time.Your Mission Statement should broadly define the boundaries and routes that you’ll use to keep you from taking too many detours or unplanned excursions along the road to your final destination or objectives. Your mission can be changed as your business expands and takes on broader or more focused initiatives in response to market needs and trends.

Your pledge as a good Health & Safety Leader.

The saying: “garbage in, garbage out” also rings true to the Health and Safety culture in any organisation. The top management of an organisation normally determines the direction the followers are going to take. If the CEO is committed then there is always time, money and other resources available for occupational health and safety. The employees feel that they are valued and that business deals are
not the only issue of concern/importance. When the CEO considers Health and Safety as a fifth wheel and an unnecessary expense that is just affecting the business negatively, then there is no money, no manpower and no time for Health and Safety. This culture normally leads to hiding of incidents, window-dressing and a general ignorance to everything that could remotely be linked to H&S - the end
result is an increase in accidents and a poor Health and Safety record.

Environmental Incidents and Emergency Reporting

So what precisely is an environmental incident and when do you emergency report? When last did you have an environmental management incident? Nothing serious you might say, just an effluent pipe overflowed for a couple of days into the receiving wetland, no emergency incidents here. So how exactly do you tell if you have experienced an environmental incident? The National Environmental Management Act (NEMA) defines an ‘incident’ as an unexpected sudden occurrence, including a major emission, fire or explosion leading to serious danger to the public or possible serious pollution of or detriment to the environment, whether immediate or delayed. Unfortunately, there is no specific definition for ‘potentially serious pollution’ so you might have to be creative and use the potentially seriousness significance rating system? Or as a rule of thumb if the incident has the ability to pollute any resource such as soil, water or air and you are unable to stop the pollution from spreading within an hour or so, it can be considered and emergency incident.
